Vibemap is not intended for children under 13 years of age. No one under age 13 may provide any information, including but not limited to Personal Information (as defined below) to or on our website or our mobile application. We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on this website or our mobile application through any of its features, register on this website, make any purchases through this website or our mobile application, use any of the interactive or public comment features of this website or our mobile application, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will take appropriate steps to delete that information. If you are a parent or guardian who believes that we might have any information from or about a child under 13, please disclose us and contact us at privacy@vibemap.com

INFORMATION WE COLLECT ABOUT YOU

We collect several types of information from and about users of Vibemap, including information:
by which you may be personally identified, such as name, postal address, email address, telephone number, or any other identifier by which you may be contacted online or offline (“Personal Information”); that is about you but individually does not identify you; and/or we may collect other information when you use our website and/or mobile application, such as information about your device, hardware and software information, such as your mobile device identifiers, IP address, or browser information (including browser type and language preference). We collect your location and motion information through your IP address, WiFi, Bluetooth, and GPS coordinates (e.g., latitude/longitude) available through your mobile device, motion information such as altitude, heading and speed. We may collect sensory and motion data from your mobile device including gyroscope, accelerometer, compass and Bluetooth (including, information related to your motion activity such as whether you are cycling, walking running or driving, and information about your speed, acceleration and deceleration).

HOW WE COLLECT INFORMATION ABOUT YOU

We collect information directly from you when you provide it to us when you visit our websites, use our apps, read our emails or otherwise engage with us, we may automatically collect certain information about your device through a variety of technologies, including cookies, web beacons, log files, embedded scripts, location-identifying technologies, or other tracking/recording tools (collectively, “Tracking Technologies”), and we may combine this information with other Personal Information we collect about you. We use these Tracking Technologies to collect usage and device information, such as information about the computer, tablet, smartphone or other devices you use, for example, your device’s telephone number (if it has one), your IP address, browser type, Internet service provider, platform type, device type/model/manufacturer, operating system, phone number, mobile carrier, date and time stamp, a unique ID that allows us to uniquely identify your browser, mobile device or your account (including, for example, a UDID, IDFA, Google Ad ID, Windows Advertising ID or other persistent device identifier or Ad ID), battery life, whether the device is connected to WiFi, and other such information. With your permission, we may also access your photo or camera roll. We also collect information from third parties, for example, our business partners.

INFORMATION WE COLLECT THROUGH AUTOMATIC DATA COLLECTION TECHNOLOGY.

As you navigate through our mobile application or website, we may use automatic data collection technologies, including Google Analytics to collect certain information about your equipment, browsing actions, and patterns, including:

  • referral/exit pages;
  • how frequently you access our website and/or our mobile application;
  • whether you open emails or click the links contained in emails;
  • whether you access our website and/or mobile application from multiple devices;
  • the features you use;
  • the links you click;
  • the ads you view and click on;
  • purchase transaction information;
  • your location when you access or interact with our website and mobile application;
    technical related information about your computer or device and operating and/or network systems (such as IP Address and device ID);
  • information about your engagement with certain features and usage statistics;
  • other similar actions.

We also collect information about the details of your visits to our website or mobile application, including location data, logs, and other communication data and the resources that you access and use on the website. Among other things, we will collect data about the type of smart device or computer you use, your Internet connection, your IP address, your operating system, and your browser type.
The information we collect automatically is used for statistical data and will not include Personal Information. We use this data to improve our mobile application and website and our service offerings. To the extent that you voluntarily provide Personal Information to us, our systems will associate the automatically collected information with your Personal Information.

Where you have consented to Vibemap’s Privacy Policy including processing of your information, you may withdraw that consent at any time and opt out of certain processing activities, such as targeted marketing communications. Even if you opt out, we may still collect and use information regarding your activities on our websites and/or information from the advertisements on third party websites for non-interest-based advertising purposes, such as to determine the effectiveness of the advertisements.

USE OF COOKIES AND PIXELS
Vibemap utilizes a standard technology called “cookies” and server logs to collect information about how our website or mobile application is used. Information gathered through cookies and server logs may include the date and time of visits, the pages viewed, time spent on Vibemap, and the websites visited just before and just after our own, as well as your IP address.

A cookie is a very small text document, which often includes an anonymous unique identifier. When you visit a website, that site’s computer asks your computer for permission to store this file in a part of your hard drive specifically designated for cookies. Each website can send its own cookie to your browser if your browser’s preferences allow it, but (to protect your privacy) your browser only permits a website to access the cookies it has already sent to you, not the cookies sent to you by other sites.

Pages of our website and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Vibemap, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

We also may use technological equivalents of cookies, including social media pixels. These pixels allow social media sites to track visitors to outside websites so as to tailor advertising messages users see while visiting that social media website. We reserve the right to use these pixels in compliance with the policies of the various social media sites.

THIRD PARTY USE OF COOKIES

Some content or applications, including advertisements, on Vibemap are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use Vibemap. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

EMAIL AND PUSH NOTIFICATIONS

We are committed to keeping your e-mail address confidential. We do not sell, rent, or lease our subscription lists to third parties and will not disclose your email address to any third parties except as set forth in our DISCLOSURE OF YOUR INFORMATION section below.

In compliance with the CAN-SPAM Act, all emails sent from our organization will clearly state who the email is from and provide clear information on how to contact us at privacy@vibemap.com. In addition, all e-mail messages will also contain concise information on how to remove yourself from our mailing list so that you receive no further e-mail communication from us. In addition, you can decide to stop getting push notifications by updating your settings.

HOW DO WE USE THE INFORMATION THAT YOU PROVIDE US?

We use Personal Information for purposes of customizing your Vibemap experience based on your location and your onsite and offsite behavior; presenting Vibemap and its contents to you, including providing you with information, offers and marketing materials; providing you with information about your subscription; identifying you across different browser sessions and devices; providing customer service; and making available other items and services to you.

We may use this information to create non-directly identifiable information that we may use alone or in the aggregate with information obtained from other sources as set forth herein in order to:

  • Help us to optimally deliver our existing services;
  • To develop new products and services;
  • For research and internal analysis;

For instance, from time to time, Vibemap may perform research (online and offline) via surveys. We may engage third-party service providers to conduct such surveys on our behalf (all survey responses are voluntary). The survey responses may be utilized to:

  • Determine the effectiveness of our services,
  • Perform various types of communications, advertising campaigns, and/or promotional activities.
  • Learn more about our members and potential members and their individual and collective needs

We use information collected through the use of Tracking Technologies to:

  • Remember information so that you will not have to re-enter it during your visit or the next time you visit our website or our mobile application;
  • Authenticate your access;
  • Keep track of your in-app specified preferences or choices;
  • Display a personalized browsing history
  • Provide custom, personalized content and information, including targeted content and advertising;
  • Record your device’s location and movements;
  • Identify and contact you across multiple devices;
  • Provide and monitor the effectiveness of our services and our marketing campaigns;
  • Monitor aggregate metrics such as total number of visitors, members, traffic, and demographic patterns;
  • Provide specific technical support (diagnose or fix technology problems reported by our members or engineers that are associated with certain IP addresses or User IDs;
  • Detect or prevent fraud or other harmful activities;
  • Automatically update our mobile application on your system and related devices; and
  • Otherwise plan for and enhance our website or mobile application.

DISCLOSURE OF YOUR INFORMATION

As a general rule, we do not sell, rent, lease or otherwise transfer any information collected whether automatically or through your voluntary action.

However, we may disclose your Personal Information to a third party, including a lawyer or collection agency, when necessary to enforce our terms of service or any other agreement between you and us.
We also may provide your information to any successor in interest in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our asserts and/or business.

We may disclose information when legally compelled to do so, in other words, when we, in good faith, believe that the law requires it to comply with any court order or other legal obligation or for the protection of our legal rights or when compelled by a court or other governmental entity to do so.
We may disclose your Personal Information to our vendors and consultants who perform services on our behalf or who help us provide our services, such as accounting, managerial, technical, email or chat services, marketing or analytic services, fraud prevention, bot detection, web hosting, and to other third-party partners or service providers who contractually agree to process Personal Information solely as necessary to provide services or features to our members on our behalf.

Vibemap’s business partners, such as Placer.ai, provide important services to us as our service provider as well as have the right to commercialize aggregated data for certain purposes while also upholding your privacy. In particular, Placer.ai is an analytics company focused on places of interest. Placer processes data on our behalf to provide important insights into places visited and also has the right to monetize solely aggregated data, again about places visited. You may opt-out of Placer’s independent monetization of your data—even in aggregated form–by opting out of data sales by writing us at privacy@vibemap.com with the subject line “Do Not Sell or Share My Personal Information” or completing “Do Not Sell My Information” form.

At this time, we do not disclose Personal Information related to individuals who access our website or mobile application from the European Economic Area (the “EEA”), Switzerland, the United Kingdom (the “UK”), or Korea to third parties for their independent marketing and/or monetization purposes. If we decide to disclose such personal data of EEA, Swiss, the UK, or Korean residents in the future for third-party independent use, individuals will first have the opportunity to provide opt-in consent.
We will never disclose your telephone number (in a non-obfuscated format) with any of our third-party business partners, vendors, or consultants for their independent SMS marketing purposes without your explicit, affirmative opt-in consent.

We may share with third parties, including advertisers and service providers, anonymized, aggregated and/or anonymous data we collect about you and other members, such as de-identified demographic information, de-identified location information, and information about the computer or device from which you access our website and/or our mobile application or the results of hashing your email address.

HOW DO WE PROTECT YOUR INFORMATION AND SECURE INFORMATION TRANSMISSIONS?

We employ commercially reasonable methods to ensure the security of the information you provide to us and the information we collect automatically. We cannot guarantee, and you cannot reasonably expect that our databases will be immune from any wrongdoings, malfunctions, unlawful interceptions or access, or other kinds of abuse and misuse. This includes using standard security protocols and working only with reputable third-party vendors. Email is not recognized as a secure medium of communication. For this reason, we request that you do not send private information to us by email and doing so is at your own risk. Some of the information you may enter on Vibemap may be transmitted securely via a secure medium known as Secure Sockets Layer, or SSL. Credit Card information and other sensitive information is never transmitted via email.

We have implemented appropriate standards to reduce the risk of unauthorized or unlawful access to your Personal Information. No security system is impenetrable, and we cannot absolutely guarantee the security of our systems and your information.

We will never send you unsolicited messages or contact you by phone requesting sensitive information. This may include account ID, password, payment, or national ID numbers. Please note that emails and other communications you send to us are not encrypted, and we strongly advise you not to share any sensitive information through these means.

If any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and, where appropriate, notify the impacted individuals and take steps in accordance with any applicable laws and regulations.

We may use software programs to create summary statistics, which are used for such purposes as assessing the number of visitors to the different sections of our site, what information is of most and least interest, determining technical design specifications, and identifying system performance or problem areas.

For site security purposes and to ensure that this service remains available to all users, we use software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.

You are responsible for the secrecy of your password and ensuring the email address associated with your account(s) is accurate. We use your email address to contact you about service updates, changes to our policies, and account activities such as requests for your information. We recommend using a strong password unique to this service. If you believe your account has been compromised, change your password immediately via the applicable app or website.

THIRD PARTY WEBSITES

Our website or mobile application may contain links to other websites. If you choose to visit other websites, we are not responsible for the privacy practices or content of those other websites, and it is your responsibility to review the privacy policies at those websites to confirm that you understand and agree with their policies.

PAID PARTNERSHIP STANDARDS

We define a Paid Partnership as any content on Vibemap that features or is influenced by a business partner for an exchange of value, such as if a business partner has paid or otherwise incentivized a user to save the content.

All Paid Partnerships must disclose the commercial nature of their content. In addition to abiding by the Community Guidelines, users that participate in Paid Partnerships are responsible for complying with:

All applicable laws and regulations, including but not limited to, all advertising laws and Federal Trade Commission regulations including the FTC’s Endorsement Guidelines.

All applicable disclosures required to indicate the commercial nature of your content.

Promoted content must also abide by our Standards of Decorum.

To prevent inauthentic content and behavior make sure you’re sharing relevant content to relevant places and events, keep the content of what you share high-quality and avoid spamming others.

Share content you have an authentic interest in. Don’t incentivize or pay people to distribute content in large volumes. For example, a business can’t pay people directly for each place or event where they leave vibes and tips. It is acceptable for a business to pay someone to curate their shared content and promote their places and events. It’s also encouraged for businesses to incentivize customers in ways that are in accordance with Vibemap’s mission.

AFFILIATE STANDARDS

Affiliate links help content creators measure their contributors’ impact and get paid for the work that they do to bring inspiring content to Vibemap. However, affiliate programs can be targeted by spammers trying to make money by abusing the program and manipulating the Vibemap platform. Affiliates must always follow our Paid Partnership Standards. In general, each individual place should operate only one Vibemap account. That account should be that place’s authentic presence on Vibemap. Affiliate content should be original and add unique value for Vibemap. Be transparent about the commercial nature of your content. Don’t use shorteners or redirectors that make the destination domain of a link unclear or that redirect for the purpose of hiding an affiliate parameter. Don’t try to artificially manipulate Vibemap algorithms or traffic.

POLICY CHANGES

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users’ Personal Information, we will notify you by email to the email address specified in your account and/or through a notice on the website home page. The date this Privacy Policy was last revised is identified at the bottom of the page. You are responsible for ensuring we have an up-to-date active, and deliverable email address for you and for periodically visiting our website and this Privacy Policy to check for any changes.

YOUR CALIFORNIA PRIVACY RIGHTS

California residents can make certain requests about their Personal Information under the California Consumer Privacy Act (“CCPA”). Specifically, if you are a California resident, you have the right to request any or all of the following information relating to your Personal Information we have collected and used in the last 12 months (upon verification of your identity):

  • provide you with the specific pieces of Personal Information we have collected about you and information about;
  • the categories of Personal Information we have collected about you;
  • the categories of sources of the Personal Information;
  • the categories of Personal Information that we have disclosed to third parties for a business purpose, and the categories of recipients to whom this information was disclosed;
  • the categories of Personal Information we have sold or shared and the categories of third parties to whom the information was sold or shared; and
  • the business or commercial purpose for collecting or selling/sharing the Personal Information.

You also have the following rights with regards to your Personal Information such as:

  • the right to opt-out of Personal Information sales and shares for cross-context behavioral advertising;
  • the right to limit our use of your sensitive Personal Information;
  • the right to correct inaccurate Personal Information about you;
  • the right to delete certain information we have about you;
  • the right for us to provide you with information about the financial incentives that we offer to you, if any; and
  • the right to not receive discriminatory treatment for exercising these rights.

Certain information may be exempt from such requests under applicable law. For example, we may retain certain information for legal compliance and to secure our website. We may need certain information in order to provide our services to you; if you ask us to delete it, you will no longer be able to use our services.

Categories of Personal Information Collected

Depending on your use of our website or our mobile application, the following categories of Personal Information may have been collected in the preceding 12 months (as these processing activities are defined under applicable privacy laws, such as the California Consumer Privacy Act “CCPA” and the California Privacy Rights Act “CPRA”):

  • Identifiers; such as a real name, user name, account name, account information, ID verification information, telephone number, email address, online identifiers, device identifiers, IP address, mobile device identifiers, and shipping address;
  • Purchase information; such as payment card number, payment account details, billing address, and other payment information;
  • Characteristics of Protected Classifications under state or federal law; such as age, gender, ethnicity, and race;
  • Commercial Information; such as products or services interaction, motion, and fitness information, and purchase history;
  • Internet or Electronic Network Activity information; such as browsing history, search history, and information regarding interactions with our website and/or our mobile application, websites, mobile apps, and/or advertisements;
  • Geolocation Information; such as location data derived from IP address or device settings;
    Inferences; such as consumer preferences, drawn from the above.

Other Ways to Exercise Your California Rights

Under California’s “Shine the Light” law, California residents who provide Personal Information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us, once each calendar year, information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately preceding calendar year.

To obtain this information, please send an e-mail message to privacy@vibemap.com with “Request for California Privacy Information” in the subject line and in the body of your message. We will provide in response the requested information to you at your e-mail address.

You may also exercise the following rights:

You may submit a verifiable request for information regarding the: (1) categories of Personal Information we collect, use, or share; (2) purposes for which categories of Personal Information are collected or used by us; (3) categories of sources from which we collect Personal Information; and (4) specific pieces of Personal Information we have collected about you.

We will not discriminate against you if you exercise your privacy rights.

You may submit a verifiable request to close your account and we will delete Personal Information about you that we have collected.

Chapter 603A of the Nevada Revised Statutes permits a Nevada resident to opt-out of future sales of certain covered information that a website operator has collected or will collect about the resident. To exercise your Nevada opt-out rights: you may send an email to privacy@vibemap.com with the subject line “Nevada Privacy Rights” and include your account name and mobile telephone number. We may need to contact you to request additional information to verify your request or use this right-to-opt-out form.

As we are located in the USA, you agree that all information collected via or by Vibemap may be transferred, processed, and stored anywhere in the world, including but not limited to, the United States, the European Union, in the cloud, on our servers, on the servers of our affiliates or the servers of our service providers. Your information may be accessible to law enforcement or other authorities pursuant to a lawful request. By providing information to Vibemap, you explicitly consent to the storage of your information in these locations if you are in Korea, the EEA, Switzerland, or the UK, this may mean that your Personal Information will be stored in a jurisdiction that offers a level of protection that may, in certain instances, be less protective of your Personal Information than the jurisdiction you are typically resident in. We will implement appropriate safeguards to ensure that your Personal Information is treated securely and in accordance with applicable Korean, EEA, and UK privacy laws and this privacy policy, including: (i) ensuring that we use your Personal Information in accordance with standard data protection clauses adopted by the European Commission for transfers of personal data to recipients outside the EEA and UK; and (ii) ensuring that any recipients of your Personal Information commit to the same standards. Except in some cases where we may rely on an exception under the Australian Privacy Act 1988 (Cth), we will take reasonable steps to ensure that such overseas recipients do not breach the Australian Privacy Principles in the Privacy Act 1988 (Cth) in relation to such information.

European Union Rights

If you are within the European Union, you are entitled to certain information and have certain rights under the General Data Protection Regulation. Those rights include:

We will retain any information you choose to provide to us until the earlier of: (a) you ask us to delete the information, (b) our decision to cease using our existing data providers, or (c) the Company decides that the value in retaining the data is outweighed by the costs of retaining it.

You have the right to request access to your data that we store and the right to either rectify or erase your personal data.

You have the right to seek restrictions on the processing of your data.

You have the right to object to the processing of your data and the right to the portability of your data.
To the extent that you provided consent to us processing your personal data, you have the right to withdraw that consent at any time without affecting the lawfulness of processing based upon consent that occurred prior to your withdrawal of consent.

You have the right to lodge a complaint with a supervisory authority that has jurisdiction over issues related to the General Data Protection Regulation.

Right to Opt-out

You have the right to direct us not to sell your Personal Information at any time (the “right to opt-out”). Consumers who agreed to this Privacy Policy, including agreeing to Personal Information sales by assessing or using this website and/or mobile application, may opt-out of future sales at any time. To exercise the right to opt out, you (or your authorized representative) may submit a request to us by writing us at privacy@vibemap.com or completing a right-to-opt-out form.
